Limited Product Warranty
POL-EKO A.Polok-Kowalska sp.k. warrants that its laboratory equipment will be reasonably free of defects in materials and workmanship. This page sets out what the warranty covers, how to file a claim, and the conditions and exclusions that apply.
Warranty coverage
Two years from the date of sale, against defects in materials and workmanship.
POL-EKO A.Polok-Kowalska sp.k., a Polish partnership (the “Company”), expressly warrants to any owner that, for a period of two (2) years from the date of sale by the Distributor in the USA, the Product will be reasonably free of defects in materials and workmanship.
This Limited Warranty applies only to Products that are stored, handled, installed, operated and maintained in strict accordance with Company instructions, including but not limited to the use guide, care guide, instruction manual, installation guide and service recommendations.
Repair, replacement or refund
If the Product fails or does not perform as warranted solely due to a manufacturing defect within the warranty period, the Company will — at its sole option and subject to the exclusions below — repair or replace the Product without charge, or refund its cost.
Throughout the warranty period, the obligation to repair or replace is limited to the styles, models, products and colors of the Product available at the time of the repair, and to the specific Product that failed due to a manufacturing defect.
A repaired or replaced Product remains subject to the original warranty period, counted from the date of the original purchase. A repair or replacement does not extend the original warranty period in any manner and does not start a new warranty period.
How to file a claim
Coverage under this Limited Warranty is available on presentation of proof of original purchase or installation.
- Notify the Company in writing
Send your claim to US_CustomerSupport@pol-eko.com.pl.
- Include your details and a description of the defect
Provide your name and address, a description of the Product involved, and the nature of the defect.
- Provide proof of purchase or installation
An invoice, delivery document or installation record establishing the original date of purchase.
- Supply supporting evidence on request
The Company may require photographs, diagnostic information, serial numbers, shipping of the Product, or an on-site inspection.
Improper or incomplete documentation may delay claim processing.
Calibration and special characteristics
Where a Product has acquired specific functions, characteristics or qualities — including, but not limited to, qualities resulting from a specific process such as calibration — and such a function, characteristic or quality is lost after the repair, the Company is not liable for it and does not cover the costs of the Product re-gaining it.
Transferring the warranty
This Limited Warranty is transferable only where the new owner submits to the Company proof of the original date of purchase. A transfer entitles the new owner to coverage for the remainder of the original warranty period only.
Conditions of use
Company Products must be stored, handled, installed, used and maintained in accordance with the instructions provided by the Company, and this Limited Warranty is conditioned upon compliance with all such instructions.
Copies of the use guide, care guide, instruction manual, and installation or fabrication guides are available from your distributor or from the Company at the address below. These materials can also be read from the Product’s internal memory, requested at US_CustomerSupport@pol-eko.com.pl, or found on the Company website at polekousa.com.
What is not covered
This Limited Warranty does not cover defects caused by any of the following.
Improper use, handling or physical abuse
Impacts, dropping, improper loading, scratching, deformation, or force applied to the housing, door, hinges, shelves or internal chamber components.
Chemical or thermal abuse
Harsh chemicals, solvents, corrosive agents, extreme heat or cold, thermal shock, or chemical vapours incompatible with recommended materials.
Electrical conditions not meeting specifications
Improper voltage, unstable power supply, surge events, missing surge protection, incompatible UPS systems, or incorrect wiring.
Environmental and installation issues
Operation outside the specified ambient temperature or humidity; inadequate ventilation; exposure to moisture, flooding, excessive dust or a corrosive atmosphere; installation not in accordance with Company guidelines.
Improper storage, installation, handling, maintenance or cleaning
Including lack of required calibration or service where applicable.
Unreasonable, unintended or unsafe use
Including operation beyond rated capacities or misuse contrary to laboratory standards.
Overloading
Excessive weight on shelves, obstruction of airflow, or storage of materials generating excessive heat or off-gassing.
Unauthorized modifications
Installation of aftermarket sensors, drilling holes, tampering with control systems, adding unauthorized accessories, or altering internal components.
Pre-existing visible defects
Products installed or used despite known or visible manufacturing irregularities such as surface appearance variations.
Minor cosmetic issues
Including stains, scratches, abrasions, colour tone variations, surface imperfections or texture differences.
Dissatisfaction with appearance
Surface finishes, colour tone, aesthetic variations, or minor cosmetic deviations inherent to manufacturing.
Damage occurring during shipping
After the Product has left the Company facility, or during customer return shipments.

Laboratory contents and data
The Company is not responsible for any loss, damage or deterioration of:
- samples, biological materials, reagents, cultures and chemicals;
- research data, digital records and experimental results;
- any economic or scientific impact resulting from Product failure, misuse, power loss or user error.
Any information or suggestion by the Company concerning applications, specifications or compliance with codes and standards is provided solely for your convenient reference and without any representation as to accuracy or suitability. You must verify and test the suitability of any such information for your specific application.
Disclaimer of warranties
THE WARRANTIES SET FORTH HEREIN ARE THE ONLY WARRANTIES MADE BY COMPANY IN CONNECTION WITH THESE PRODUCTS. COMPANY CAN NOT AND DOES NOT MAKE ANY IMPLIED OR EXPRESS WARRANTIES WITH RESPECT TO THE PRODUCT, AND DISCLAIMS ALL OTHER WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. PRODUCTS SOLD BY COMPANY ARE SOLD ONLY TO THE SPECIFICATIONS SPECIFICALLY SET FORTH BY COMPANY IN WRITING. OTHER THAN THE LIMITED WARRANTY SET FORTH HEREIN, COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED. COMPANY’S SOLE OBLIGATION UNDER THIS WARRANTY SHALL BE REPAIR, REPLACEMENT OR REFUND OF NON-CONFORMING PRODUCTS. BUYER ASSUMES ALL RISK WHATSOEVER AS TO THE RESULT OF THE USE OF THE PRODUCTS PURCHASED, WHETHER USED SINGULARLY OR IN COMBINATION WITH ANY OTHER PRODUCTS OR SUBSTANCES.
Limitation of liability
No claim by the buyer or owner of any kind, including claims for indemnification, shall be greater in amount than the purchase price of the Products in respect of which damages are claimed.
IN NO EVENT SHALL COMPANY BE LIABLE TO BUYER/OWNER IN TORT, CONTRACT OR OTHERWISE, FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, RELIANCE, STATUTORY, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF USE, LOSS OF TIME, LOSS OF REVENUES, INCONVENIENCE, LOSS BUSINESS OPPORTUNITIES, DAMAGE TO GOOD WILL OR REPUTATION, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES COULD HAVE BEEN REASONABLY FORESEEN, IN CONNECTION WITH, ARISING OUT OF, OR AS A RESULT OF, THE SALE, DELIVERY, SERVICING, USE OR LOSS OF USE OF THE PRODUCTS SOLD HEREUNDER, OR FOR ANY LIABILITY OF BUYER TO ANY THIRD PARTY WITH RESPECT THERETO.
